Terms of service

The rules for using southbend.tech, the signed-in app, the diagnostic chat, and the audit itself. Plain English, and short on purpose.

Who these terms are between

These terms are an agreement between you and southbend.tech, a studio operating from South Bend, Indiana ("we", "us"). They cover this website, the signed-in app at southbend.tech/app, the self-serve diagnostic chat, and the services we sell. Using any of it means you accept these terms. If you are agreeing on behalf of a business, you are confirming you are allowed to bind that business.

Your account

The app is reached by signing in with Google. You are responsible for the Google account you use and for anything done through it. Do not share access with someone who should not see your report. Tell us at info@southbend.tech if you think someone else has gotten into your account, and we will cut off access. We can suspend or close an account that is being used to abuse the service.

What we sell

The AI Business Audit — $999 flat. A 45-minute diagnostic conversation about how your week actually goes, followed by a written, plain-English report: what is quietly costing you time, three to five fixes named and priced, and a short quick-start plan.

The guarantee. If the audit does not identify at least five hours a week of recoverable time, tell us within 30 days of receiving your report and we refund the $999 in full. You keep the report. The guarantee is about what the audit finds, not about whether the fixes get implemented — that part depends on work happening inside your business.

Automation builds and the Concierge. Anything past the audit is optional and scoped separately in writing, at prices quoted at the time. Nothing on this site obliges either of us to that work.

Prices shown on the site are current as of the date you see them and may change before you book. The price we quote you in writing is the price you pay.

What we need from you

An audit is only as good as what you tell us. You agree that the information you share is yours to share, and that you will not send us anyone else's confidential data, protected health information, or payment card data. If a fix we recommend touches a system you do not control, getting permission to change it is on you.

The diagnostic chat

The self-serve chat is a free, automated interviewer powered by a large language model. It is a conversation starter, not advice, and it can be wrong. Do not type anything into it you would not want stored. It is rate-limited and capped, and we may change or withdraw it at any time.

Not professional advice

We are a technology studio. What we deliver is operational and technical analysis — not legal, tax, accounting, medical, or investment advice. Decisions you make about your business remain yours, and for regulated questions you should talk to the professional who handles them.

Who owns what

Yours. The information you give us about your business stays yours, and the report we write for you is yours to use however you want inside your business — share it with your team, hand it to another vendor, act on it or ignore it.

Ours. This site, its copy, its design, our methodology, and any frameworks, templates, or tooling we bring to the engagement remain ours. You may not resell or republish our reports or site content as your own product.

Anonymous learning. We may describe patterns we see across engagements — never your name, your numbers, or anything identifying, unless you have said yes in writing.

Acceptable use

Do not use this site or the app to:

  • Break the law, or help someone else break it.
  • Scrape, hammer, or overload the site, the chat, or the forms.
  • Probe, scan, or try to get into parts of the system that are not yours.
  • Submit someone else's information as your own, or impersonate anyone.
  • Upload malware, or use the chat to generate abusive or illegal content.

Availability

We run a small studio, not a utility. The site and the app are provided as they are, without a promised uptime, and we may change, pause, or retire features. We will give notice before anything that would leave a paying client without their report.

Disclaimers

Except for the audit guarantee above, the site, the app, the chat, and the services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Recovered hours, savings, and outcomes described on this site are what we have seen elsewhere, not a promise about your business.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising from your use of the site, the app, or our services. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limits, in which case they apply as far as they legally can.

Ending it

You can stop using the site at any time, and you can ask us to close your account and delete your data — see the privacy policy. We can suspend access for a breach of these terms. Ownership, disclaimers, and liability survive the end of the agreement.

Governing law

These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts located in St. Joseph County, Indiana, and we both agree to that venue. Before filing anything, email us — nearly everything is faster to fix in a conversation.

Changes

If we change these terms we will update the effective date at the top of this page. Continuing to use the site after a change means you accept the new terms. Terms in a signed engagement agreement override anything here that conflicts with them.
